These Terms of Use ("Terms") govern your access to and use of the Partspark platform, website, and related services ("Platform") operated by Partspark Pty Ltd (ABN to be confirmed) ("Partspark", "we", "us", or "our"), a company registered in Queensland, Australia.
By accessing or using the Platform you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
You must be at least 18 years of age and have the legal capacity to enter into a binding contract under Australian law. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

We reserve the right to suspend or terminate accounts that breach these Terms or are used for fraudulent purposes.
Partspark provides an online platform for on-demand custom manufacturing services including, but not limited to, laser cutting, CNC folding, fastener insertion, and finishing services. Orders are fulfilled through our network of vetted manufacturing partners located in Australia.
All orders are subject to acceptance by us. We may decline or cancel an order at our discretion, including where a design is not manufacturable, pricing errors occur, or stock is unavailable. If we cancel an accepted order, you will receive a full refund of any amounts paid.
All prices displayed on the Platform are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated. Prices are subject to change without notice; however, the price confirmed at checkout will apply to your order.
Payment must be made in full at the time of order via the payment methods available on the Platform. We use third-party payment processors (such as Stripe) and do not store your full payment card details.
Estimated delivery timeframes are provided at checkout and are indicative only. While we make every reasonable effort to meet estimated timeframes, we are not liable for delays caused by circumstances beyond our reasonable control, including carrier delays, natural events, or supply disruptions.
Risk in the goods passes to you upon delivery to the shipping address provided. Title in the goods passes to you upon receipt of full payment.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms purports to modify or exclude the conditions, warranties, and undertakings implied by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded.
If you believe goods are faulty, not as described, or do not meet consumer guarantees, please contact us at support@partspark.com.au within 30 days of delivery. We will assess the issue and provide an appropriate remedy in accordance with the Australian Consumer Law, which may include a repair, replacement, or refund.
All content on the Platform — including text, graphics, logos, software, and design — is owned by or licensed to Partspark and is protected by Australian and international intellectual property laws. You must not reproduce, modify, distribute, or otherwise use any Platform content without our prior written consent.
By uploading designs, files, or other content ("User Content") to the Platform, you grant us a non-exclusive, royalty-free licence to use that content solely for the purpose of fulfilling your orders and providing the Platform services. You retain all ownership rights in your User Content.
You represent and warrant that your User Content does not infringe any third-party intellectual property rights.
You agree not to use the Platform to:
To the maximum extent permitted by law (and subject to any non-excludable rights under the Australian Consumer Law), Partspark's total liability to you for any claims arising out of or in connection with these Terms or your use of the Platform is limited to the amount you paid to us for the relevant order.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill.
You agree to indemnify and hold harmless Partspark, its directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your use of the Platform, or your violation of any law or third-party rights.
We may suspend or terminate your access to the Platform at any time, with or without cause, upon reasonable notice. Upon termination, your right to use the Platform ceases immediately, but any provisions that by their nature should survive termination will continue to apply.
We may update these Terms from time to time. If we make material changes, we will notify you via the Platform or by email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
